Activist Groups Urge Obama to Reject Boy Scout Honor

Oral Argument In Barnes-Wallace v. BSA (San Diego's Camp Balboa)
When a U.S. District Judge ruled that the City of San Diego's lease of 18 acres of Balboa Park to the BSA is unconstitutional,
the BSA appealed.
That appeal, captioned Barnes-Wallace v. BSA, was argued before Judge William C. Canby Jr., Judge Andrew J. Kleinfeld,
and Judge Marsha S. Berzon, of the Ninth Circuit Court of Appeals, in Pasadena, California, on February 14, 2006.
Mark W. Danis of Morrison & Foerster LLP argued the case for the plaintiffs, opposing the BSA's religious-viewpoint
urging affirmance of the decision below. George A. Davidson, of Hughes, Hubbard, & Reed, argued the case for
the BSA. Eric W. Treene, of the United States Department of Justice, Civil Rights Division, joined him in defending
government support for the BSA and its discriminatory policies.

The three judges did not indicate when or how they would rule. The Ninth Circuit may take from two months, to
more than a year, to decide important appeals.
